2. Definitions

  1. Customer: the person or organisation placing an order with Dendroboor.
  2. Consumer: a customer acting as a private individual, not for professional or business purposes.
  3. Business customer: a customer acting in the course of a profession or business, including universities, research institutes and other organisations.
  4. Products: the corers, accessories and the resharpening service offered on this website.

3. Applicability

  1. These terms apply to every order placed via dendroboor.nl and to every agreement between Dendroboor and the customer.
  2. By placing an order, the customer confirms having read and accepted these terms and the information on the Drilling risks page.
  3. General terms and conditions of the customer do not apply, unless Dendroboor has accepted them in writing.
  4. If any provision of these terms is invalid, the remaining provisions remain in full force.

4. Offer and prices

  1. All prices on the website are in euros and exclusive of VAT. Packing and registered shipping are charged at a flat rate of € 20 per order. The total amount, including shipping and any applicable VAT, is shown before the order is placed.
  2. Business customers established in an EU member state other than the Netherlands who provide a valid EU VAT number are invoiced without VAT (reverse charge). All other customers are charged Dutch VAT (21%).
  3. Obvious mistakes or errors in the offer or prices do not bind Dendroboor.
  4. Images and descriptions are given as accurately as possible, but small deviations do not entitle the customer to compensation or cancellation.

5. Orders and agreement

  1. The agreement is concluded when the customer receives the order confirmation by email.
  2. Products are only sold and delivered to customers within the European Union. Dendroboor may refuse or cancel an order, for example if the delivery address is outside the EU or if the information provided is incomplete or incorrect. Any amount already paid will then be refunded.

6. Payment

  1. Payment is made by bank transfer. After placing the order, the customer receives the order confirmation with the bank details and the total amount.
  2. The customer pays the total amount within 14 days of the order date, stating the order number. If payment has not been received within this period, Dendroboor may cancel the order.
  3. Orders are shipped only after the payment has been received in full.
  4. The invoice is sent by email after the payment has been received.

7. Delivery

  1. Orders are shipped within 7 days after the payment has been received, by registered mail. Delivery within the EU depends on the carrier and usually takes 2–5 working days. Delivery times are indicative; exceeding them does not entitle the customer to compensation, but a consumer may cancel the order if delivery has not taken place within 30 days.
  2. For consumers, the risk of loss or damage passes to the customer upon delivery. For business customers, the risk passes when the goods are handed over to the carrier.
  3. Customers must check the delivery upon receipt and report any transport damage or incorrect delivery within 7 days, as described on the Shipping & returns page.

8. Right of withdrawal (consumers only)

  1. Consumers have the right to withdraw from the purchase within 14 days of receiving the goods, without giving any reason. The procedure is described on the Shipping & returns page.
  2. The right of withdrawal does not apply to the resharpening service once it has been fully performed with the consumer’s prior consent.
  3. The right of withdrawal does not apply to business customers.

9. Resharpening service

  1. The resharpening service is ordered and paid for via the shop before the corer is sent in.
  2. The customer sends the corer, securely packed and stating the order number, to the address in article 1. The shipment to Dendroboor is at the customer’s cost and risk.
  3. After resharpening, the corer is returned by registered mail. The return shipping costs are included in the order.
  4. If the corer turns out to be damaged to such an extent that resharpening is not possible or not useful, Dendroboor will inform the customer and agree on a solution before carrying out any work.

10. Warranty and complaints

  1. Dendroboor guarantees that the products meet the agreement and the specifications stated on the website. Consumers are entitled to the statutory warranty (conformity).
  2. Complaints must be reported to Dendroboor in writing as soon as possible after they are discovered, and for business customers no later than 14 days after delivery.
  3. The warranty does not cover defects or damage caused by incorrect or careless use, including (but not limited to): applying lateral (transverse) loads, drilling without clearing chips and dust, overheating, drilling in unsuitable materials (such as nails or metal), resharpening by third parties, modifications, or not following the instructions and the Drilling risks.
  4. The sharpness of the cutting edges decreases with use. Normal wear is not a defect.

11. Use and safety

  1. The customer is responsible for the safe, professional and lawful use of the products, including obtaining permission from owners before sampling and complying with applicable health and safety regulations.
  2. The customer must follow the drilling instructions on the website and the Drilling risks page, and ensure that everyone using the products is informed of them.

12. Liability

  1. The liability of Dendroboor is limited to direct damage and to a maximum of the invoice amount of the order concerned.
  2. Dendroboor is not liable for indirect or consequential damage, including loss of profit, loss of samples or data, or damage to buildings, structures or objects that have been sampled.
  3. Dendroboor is not liable for damage or injury caused by not following the instructions and safety information, or by use for which the products are not intended.
  4. These limitations do not apply in case of intent or gross negligence on the part of Dendroboor, and do not affect the mandatory statutory rights of consumers.

13. Retention of title

Delivered products remain the property of Dendroboor until the customer has paid the full amount due.

14. Privacy

Dendroboor processes personal data in accordance with the Privacy policy.

15. Applicable law and disputes

  1. These terms and all agreements with Dendroboor are governed by Dutch law. The United Nations Convention on Contracts for the International Sale of Goods (CISG) does not apply.
  2. Disputes with business customers are submitted exclusively to the competent court in the district of Noord-Nederland. Consumers retain the protection of the mandatory provisions of the law of their country of residence and may also turn to the competent court there.
  3. We always prefer to resolve questions or complaints together first: please contact us at info@dendroboor.nl.

16. Changes

Dendroboor may change these terms. The version that applies is the one published on the website at the time the order was placed.
